There was a motion to accept the minutes of the meeting of March 8th. The motion was seconded and accepted with a vote of 5-0-0.
Mr. Richard Vacca’s Agent Report has been appended to the minutes.
There was a motion to authorize Mr. Vacca to forward a letter of interest on serving on the Conservation Commission from Mr. Andy Tolland to the Town Administrator. The motion was seconded and accepted with a vote of 5-0-0.
There was a motion to authorize Mr. Vacca to contact Mr. Jeffery Senterman to attend a Conservation Commission meeting for an Associate Member position. The motion was seconded and accepted with a vote of 5-0-0.
Ms. Margaret Ranieri appeared before the Commission regarding Lot 13 Harmony Farms, which is the last remaining lot to be built in the subdivision. The Orders of Conditions has expired in November 2006 and this lot has not yet been finished. Ms. Ranieri requested that the Commission either extend the existing Order of Condition retroactively or issue an Enforcement Order requiring the work to be completed in accordance with the approved plans.
There was a motion to require Ms. Ranieri to file a new Notice of Intent for the work on Lot 13 Harmony Farms and to waive the local fees. The motion was seconded and accepted with a vote of 5-0-0.
Public Hearing – Notice of Intent – 16 Vine Street – Torizzo
The Commission Chairman stated that a letter has been received from the applicant’s representative dated March 22nd requesting a continuance of the public hearing until May 3rd, 2007.
There was a motion to continue the hearing until the May 3rd, 2007 meeting. The motion was seconded and accepted with a vote of 5-0-0.
Continued - Public Hearing – Notice of Intent – 6 Lena Circle – Calabrese - CE159-938
Mr. Steve Donatelli, a representative of Shea Engineering, and Mr. Ron Calabrese, the applicant, both appeared before the Commission for the construction of an addition to existing single-family house. This proposed work will be conducted on previously disturbed area.
Mr. Donatelli presented revised plans for the review of the Commission which depicts the erosion control installed and it will remain in place until the Certificate of Compliance is issued.
He also stated that a deep sump catch basin has been added to the plan to the rear of the pavement. The existing pavement which is highlighted on the plan will be removed and the area will be loamed and seeded. The proposed pavement to be added is within the 50 ft. buffer zone.
There was a motion to close the hearing. The motion was seconded and accepted with a vote of 5-0-0.
Continued - Public Hearing – Notice of Intent – Lot 4-7 Penny Lane – Coras - CE159-934
The Commission Chairman stated that a letter has been received from the applicant’s representative dated March 22nd requesting a continuance of the public hearing until April 5th 2007.
There was a motion to continue the hearing until the April 5th, 2007 meeting. The motion was seconded and accepted with a vote of 5-0-0.
Continued - Public Hearing – Amendment Request to Orders of Conditions – 438 West Central Street - SE159-862
Mr. Alan Micale, Engineer of Ayoub Engineering, and Ms. Margaret Ranieri, the owner of the site, both appeared before the Commission for minor modifications to the existing building and site. Mr. Micale informed the Commission that he has met with Mr. Yadisernia at the site to discuss the stormwater issues and to determine if a forebay area will fit at the rear of the site to
collect the sediment and treat the water runoff. One tree will be eliminated during this work. The disturbance will be minimized off the existing curbline as much as possible.
Mr. Micale stated that this project is in the permitting process with the Planning Board.
There was a motion to authorize Mr. Vacca to write a letter to the Planning Board stating that the Conservation Commission is in favor of the plan conceptually and waiting for the Planning Board’s approval to move forward with the project. The motion was seconded and accepted with a vote of 5-0-0.
Continued - Public Hearing – Notice of Intent – Franklin Sports Mall – Washington Street – CE159-923
The Commission Chairman stated that a letter has been received from the applicant’s representative dated March 22nd requesting a continuance of the public hearing until May 3rd, 2007.
There was a motion to continue the hearing until May 3rd. The motion was seconded and accepted with a vote of 5-0-0.
GENERAL BUSINESS
Minor Buffer Zone Activity: 11 Stanwood Drive
The proposed work is for the replacement of an existing 20’x16’ deck with a 24’x16’ deck. The work will take place on previously disturbed area approximately 34 ft. from the resource area at the closest point.
There was a motion to issue a Negative Determination with the 3 Special Conditions listed in the Agent’s Report. The motion was seconded and accepted with a vote of
5-0-0.
Permit Decision: Summer Street Sewer Main – CE159-936
There was a discussion among Commission members regarding the issuance of Orders of Conditions for this project. There was a motion to issue State and Local Orders of Conditions with 54 Special Conditions. The motion was seconded and accepted with a vote of 4-0-1; 4 Yes, 0 No, 1 Abstention.
Permit Decision: Bent Street Water Main - CE159-935
There was a discussion among Commission members regarding the issuance of Orders of Conditions for this project. There was a motion to issue State and Local Orders of Conditions with 54 Special Conditions. The motion was seconded and accepted with a vote of 4-0-1; 4 Yes, 0 No, 1 Abstention.
Permit Decision: 87 Grove Street - CE159-937
There was a discussion among Commission members regarding the issuance of Orders of Conditions for this project. There was a motion to issue State and Local Orders of Conditions with 47 Special Conditions. The motion was seconded and accepted with a vote of 4-0-1; 4 Yes, 0 No, 1 Abstention.
Permit Decision: 3 Peters Lane - CE159-931
There was a discussion among Commission members regarding the issuance of Orders of Conditions for this project. There was a motion to issue State and Local Orders of Conditions with 57 Special Conditions. The motion was seconded and accepted with a vote of 5-0-0.
